About us
This website is operated by Bub and Co Aus, trading as Bub and Co ("we", "us", "our"), a business based in Sydney, Australia. We're an online store, and all orders are shipped from Sydney, NSW.
These terms apply when you use bubandco.com.au or buy from us. By placing an order, you agree to these terms, together with our Shipping Policy, Refund Policy and Privacy Policy.
1. Your rights under the Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law, which applies in New South Wales through the Fair Trading Act 1987 (NSW). Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. If anything in these terms conflicts with those rights, your rights prevail.
2. Using our website
You must be 18 or over to place an order. Please don't use our website for any unlawful purpose, to upload viruses or harmful code, to collect other people's personal information, or to interfere with the website's security. We may suspend access for anyone who does.
3. Products and safe use
We take care to describe and photograph our products accurately. Colours can look slightly different on different screens. Please read the care and safety instructions that come with each product. Always supervise babies and children when they are using feeding, teething and play products, and check products regularly for wear or damage. We may limit quantities, or stop selling a product, but this won't affect orders we've already accepted.
4. Prices and payment
All prices are in Australian dollars and include GST. Shipping costs are shown at checkout before you pay. Prices may change from time to time, but changes won't affect orders already placed. If you pay with Afterpay, Afterpay's terms also apply.
5. Orders and cancellations
When you place an order, we'll email you an order confirmation. You can cancel at no cost before your order is dispatched. Orders cannot be cancelled once they have been dispatched. We may cancel an order and give you a full refund if an item is unavailable, a product was listed at an obviously incorrect price because of an error, we can't deliver to your address, or we reasonably suspect fraud. We'll always tell you if this happens.
6. Delivery
Delivery is covered by our Shipping Policy. Products become your responsibility once they're delivered.
7. Returns and refunds
Faulty items, returns and refunds are covered by our Refund Policy.
8. Discount codes and promotions
Unless we say otherwise, only one discount code can be used per order. Discount codes and promotions can't be exchanged for cash, and any specific conditions are shown with the offer.
9. Gift cards
Gift cards are valid for at least 3 years from the date of purchase, and the expiry date is shown on the gift card. They can't be redeemed for cash except where required by law.
10. Reviews, photos and other content
Reviews must be genuine and based on your own experience. By submitting a review, photo, competition entry or other content, you allow us to display it on our website and social media. If a photo shows a child, you confirm you are their parent or guardian or have their permission, and you can ask us to remove it at any time. We publish genuine reviews, both positive and negative, and only remove content that is offensive, unlawful, off-topic or contains personal information.
11. Intellectual property
The content on our website, including our designs, images, text and logo, belongs to us or our licensors. You may not copy or use it commercially without our written permission.
12. Third-party links and services
Our website may link to other websites or use third-party services such as payment providers. Those third parties' own terms and privacy policies apply to your use of them.
13. Liability
Subject to your rights under the Australian Consumer Law, we are not liable for any loss that was not reasonably foreseeable, or for loss caused by events outside our reasonable control.
14. Privacy
We handle your personal information in line with our Privacy Policy.
15. Changes to these terms
We may update these terms from time to time. The version on our website when you place an order applies to that order.
16. Complaints and disputes
If you have a problem with an order, please contact us first. We'll do our best to resolve it quickly and fairly. If we can't resolve it, you can contact NSW Fair Trading at www.fairtrading.nsw.gov.au or on 13 32 20, or apply to the NSW Civil and Administrative Tribunal (NCAT).
17. Governing law
These terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts and tribunals of New South Wales.
